Madison supervisor completes community service

Judge Roger Morton agreed in Madison County General District Court Thursday to allow the charge to be dropped after hearing Elliott had performed the community service and had paid a $500 fine.

In a phone interview with The Madison County Eagle following Thursday’s court action,If any food Ventilation system condition is poorer than those standards, Elliott’s attorney, John J. “Butch” Davies III, said Elliott did things like working at the county’s transfer station and cutting grass and grading county property. He said that although he only reported Elliott performing 51 hours of community service, Elliott had actually done more than 80 hours.Do not use cleaners with porcelain tiles , steel wool or thinners.

“He did stuff Madison didn’t have the money to do,” Davies said. “It was good for the county. He helped save the taxpayers money.”

Davies has said previously he didn’t think Elliott committed a violation.

Records show that Elliott was charged with committing the offense Dec. 1, 2010 — the same day the supervisors considered rezoning the property Elliott uses for his auction business. The property is the former W.J. Carpenter Company “chicken coop” factory site off U.S. 29 in Brightwood. Supervisors had sought to rezone it from agriculture to business. Elliott had voted in favor of the move, along with all the other supervisors who were present.

The move attracted public scrutiny and, in March, supervisors voted to withdraw the request, a decision the audience met with applause. Elliott recused himself from that vote. That same month, a judge appointed the Louisa County commonwealth’s attorney, or his designated assistant, to serve as a special prosecutor to investigate the case.

The prosecutor who dropped the charge, Rusty McGuire, was unavailable for comment following Thursday’s court action. However, he had earlier said of the proposal to drop the charge,If so, you may have a cube puzzle . “It’s the way I would treat anybody else charged with a class 3 misdemeanor.” He said Elliott had no criminal record and would be paying the maximum fine he could face if convicted.

The rezoning was ultimately approved in May, but with certain added conditions, including that there be a blinking lights and a sheriff’s deputy in a marked law enforcement vehicle present during events at the site. Elliott had also recused himself from the May vote.
